Salary, not paid for weekends.

Howdy y’all. I make ~88k a year. I’m in a soc responsible for incident response when it comes up.

Recently we’ve been instructed to work weekends and extended hours without any additional pay. I read flsa guidelines and I think cyber security functions end up being a non-exempt profession.

Have y’all been compensated for weekend pay or fought for it?

I wouldn’t mind weekends if I was paid significantly more, but I’m pissed they gave me a 2% raise in my second year and want more money. It doesn’t seem fair that they raise low and expect weekend work without compensation.

Weekend work should be compensated.

Either with a salary, or an additional paid vacation day.

As with any legal matter, if you think you have a case under FLSA or want to investigate one, you should consult with a lawyer – not Reddit.

However, at a personal level, I think you’re **extremely** likely to be exempt. The only time I was non-exempt since being a teenager was when I was interning. [FS17D](https://www.dol.gov/sites/dolgov/files/WHD/legacy/files/fs17d_professional.pdf) and [FS17E](https://www.dol.gov/sites/dolgov/files/WHD/legacy/files/fs17e_computer.pdf) seem to be the most relevant conditions to the cybersecurity field, and you earn over 2x the salary required for exemption.

Stay mindful that you out-earn the average American *household* ([ref](https://www.census.gov/content/dam/Census/library/publications/2019/demo/p60-266.pdf)) – not that workers can’t or shouldn’t demand more from their employers (or the government, FWIW) – but FLSA is not really set up to protect high pay professionals in private industry.

If the weekend pay matters more than the job, hardball for it. If the job matters more than the pay, either you eat it or you get a new job.
